The trust is the most enduring creation of the Courts of Equity, and is a ubiquitous presence in our law. This course provides a basic introduction to the trust. It examines its origins; the distinction between trusts and other legal relationships; the requirements for establishing a trust (the three certainties and constitution); purpose trusts (charitable and non-charitable); and trusts arising by operation of law (resulting and constructive trusts). 

This course does not cover the administration of trusts – appointment and removal of trustees, trustees’ powers and duties etc, the taxation of trusts. That is why it is a 3-credit course, not the usual 4-credits for an upper year survey course.

Evaluation
A final 3-hour exam, part of which (1 hour) is a closed book test and part of which (2 hours) is an open-book problem question (or questions).
